By using Novelhaus, you agree to these terms. Please read them carefully before creating an account or submitting content. Sections 10–13 limit our liability, require you to indemnify us, and require disputes to be resolved by individual arbitration with a waiver of class actions and jury trial.
These Terms of Service ("Terms") are a binding agreement between you and SAMCHEONGHAUS, Inc., a Delaware C corporation ("Novelhaus," "we," "us," or "our"). By accessing or using Novelhaus (the "Platform"), you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Platform.
You must be at least 18 years old to create an account or submit content. By registering, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. Users under 18 may view publicly available content without an account.
Novelhaus hosts and facilitates content created by users. We do not endorse, and are not responsible for, any User Content, opinions, recommendations, or advice expressed by users. We act as an interactive computer service provider and do not assume the obligations of a publisher with respect to User Content. We are not liable for any loss or damage arising from your reliance on User Content or from your interactions with other users.
We have the right, but not the obligation, to monitor, review, remove, or disable access to any User Content at our discretion, including content we believe violates these Terms, is unlawful, or may expose us or others to liability. Removal does not waive any of our rights.
The Platform uses AI-assisted tools as part of the manuscript and production pipeline. AI-generated or AI-assisted output may contain errors, inaccuracies, or unintended similarities to existing works. We make no warranty regarding the accuracy, originality, or fitness of any AI-assisted output, and you are responsible for reviewing any output before relying on or publishing it. You must disclose AI-generated content where required under Section 8.
Novelhaus offers two separate programs with different ownership and revenue models. The applicable terms depend on the program you choose for a given work.
7.1 Collaborative Program. Authors who participate in the Platform's collaborative creation process are eligible for revenue distribution as follows:
7.2 Single Writer (Solo Publishing) Program. Single Writer is a separate program for authors who publish their own manuscript independently. In summary, you retain 100% ownership of your work, Novelhaus takes a 30% e-book sales commission (you receive 70% of net revenue), and optional production services may be charged separately. Single Writer is governed by its own Single Writer Agreement, which is an appendix to these Terms; see also the Single Writer Process page.
7.3 Common terms. Full details of the Collaborative Program are in the Author Terms & Whitepaper. All payouts are processed via Stripe Connect, are paid only when actually received by us, and may be subject to processing fees, refunds, chargebacks, and minimum payout thresholds. You are solely responsible for any taxes on amounts you receive. We will collect tax information and issue tax forms (such as Form 1099-NEC or 1099-K) only where and as required by applicable law; thresholds and forms are set by law and may change. Nothing here is tax advice — please consult your own tax advisor.
We may suspend or terminate your account or access at any time, with or without notice, for any violation of these Terms or for conduct that we reasonably believe is harmful or unlawful. You may delete your account at any time via Account Settings. Deletion masks your personal data; contributions to published collaborative novels may be retained, with anonymized attribution, for system integrity as described in the Privacy Policy. Sections that by their nature should survive termination (including Sections 4–6 and 10–15) will survive.
The platform, including all content, features, and AI-assisted output, is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, SAMCHEONGHAUS, Inc. disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the platform will be uninterrupted, secure, error-free, or free of harmful components, or that any content or output will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the maximum extent permitted by law, in no event will SAMCHEONGHAUS, Inc. or its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the platform, even if advised of the possibility of such damages.
In no event will our total aggregate liability for all claims relating to the platform exceed the greater of (a) the total amounts you paid or received from us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless SAMCHEONGHAUS, Inc. and its officers, directors, employees, agents, and successors from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content; (b) your use of the Platform; (c) your violation of these Terms or any applicable law; or (d) your violation of any third-party right, including any intellectual property or privacy right. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us. This Section survives termination of your account.
Please read this Section carefully — it affects your legal rights.
Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
Informal resolution. Before filing any claim, you agree to first contact us at legal@novelhaus.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration. Except as stated below, any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules. Judgment on the award may be entered in any court of competent jurisdiction.
Class action & jury trial waiver. To the maximum extent permitted by law, all claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and we each waive any right to a jury trial.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court to protect intellectual property or confidential information.
Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@novelhaus.com within 30 days of first accepting these Terms.
Time limit. Any claim must be filed within one (1) year after it arises, or it is permanently barred, except where applicable law prohibits such a limitation.
We may update these Terms from time to time. Material changes will be announced via email and on-platform notice at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
