These Terms govern use of Novelhaus. Please read them before creating an account, submitting content, participating in a collaborative work, using the Single Writer program, or using any paid feature. Sections 11–14 contain important warranty, liability, indemnification, and arbitration provisions.
These Terms of Service ("Terms") are a binding agreement between you and SAMCHEONGHAUS Inc., a Delaware C corporation ("Novelhaus," "we," "us," or "our"). By accessing or using Novelhaus (the "Platform"), creating an account, or submitting content, you agree to these Terms and our Privacy Policy. If you do not agree, do not create an account or submit content.
Additional terms apply when you join a specific author or publishing program. The Collaborative Author Terms and Single Writer Agreement supplement these Terms for the applicable program.
You choose which author model fits your work. The Collaborative Program requires affirmative acceptance of its 52/12/36 copyright-ownership and revenue structure and SAMCHEONGHAUS Inc.'s centralized copyright administration. If you do not agree to that structure, do not submit a Collaborative Program contribution. You may instead use Single Writer if you prefer to keep full ownership and independent control of your own manuscript, subject to the limited service rights in the Single Writer Agreement.
You must be at least 18 years old to create an account, submit content, enter a creator agreement, or receive payouts. By registering, you represent that you meet this requirement and have legal capacity to enter into these Terms. Publicly available content may be viewed without an account unless otherwise restricted.
Novelhaus performs different functions depending on the content and program. For ordinary user submissions, Novelhaus primarily provides hosting, workflow, community, moderation, and technical services. For works selected for collaborative development or publication, Novelhaus may also provide editorial coordination, AI-assisted production, rights administration, publishing, distribution, marketing, and licensing support.
For a Final Collaborative Work, SAMCHEONGHAUS Inc. is the single contractual rights-administration and commercial-control point for the shared copyright. This centralized structure is intended to reduce fragmented rights, conflicting licenses, and disputes among multiple contributors while preserving each contributor's finalized copyright ownership and revenue participation under the Collaborative Author Terms.
We do not endorse every item of User Content and cannot verify every factual statement or rights claim made by a user. We may review, restrict, remove, or disable access to content that we reasonably believe violates these Terms, infringes rights, creates legal or safety risk, or is unsuitable for the applicable program.
Copyright complaints are handled under our Copyright / DMCA Policy.
Novelhaus may use AI-assisted tools to organize contributions, suggest structure, create drafts, edit language, summarize, translate, or support other parts of the production workflow. AI tools are intended to assist human creators and editors, not to guarantee authorship, originality, accuracy, marketability, or copyright protection.
AI-generated or AI-assisted output may contain errors, factual inaccuracies, bias, or unintended similarities to existing material. Human review is required before publication. Where law, publishing policy, or a third-party distributor requires disclosure of AI-generated or AI-assisted material, users and Novelhaus must provide the required disclosure.
Copyright protection for a work involving AI may depend on the extent of human creative authorship, selection, arrangement, and modification. Novelhaus does not guarantee that any particular AI-assisted output will qualify for copyright protection.
Novelhaus currently supports two distinct author models. Program-specific terms control where they differ from this general summary.
7.1 Collaborative Program. The standard Collaborative Program uses the following matching allocation for both Final Collaborative Work copyright ownership and Distributable Revenue:
Participation requires affirmative acceptance of the Collaborative Author Terms. If you do not agree to the 52/12/36 copyright ownership allocation, the matching revenue allocation, and SAMCHEONGHAUS Inc.'s sole authority to administer and commercially exercise the copyright in the Final Collaborative Work, do not submit a Collaborative Program contribution.
The percentages are applied to Distributable Revenue, not automatically to the retail list price. "Distributable Revenue" means amounts actually received by Novelhaus from exploitation of the applicable work after refunds, chargebacks, sales or similar transaction taxes collected or remitted, and third-party marketplace, distributor, print-on-demand, payment-processing, or mandatory transaction fees directly attributable to that revenue, unless the applicable Author Terms or a separate written agreement states otherwise.
Qualification thresholds, credit finalization, withdrawal rules, payout timing, and other Collaborative Program details are governed by the Collaborative Author Terms.
7.2 Single Writer Program. Single Writer is a separate program for authors publishing their own manuscripts. The author retains 100% copyright ownership and independent control of the manuscript and story IP, while granting Novelhaus only the limited rights needed to provide the selected publishing or distribution services. The applicable Novelhaus commission, author share, optional production fees, distribution deductions, withdrawal rights, and settlement rules are governed by the Single Writer Agreement.
7.3 No guarantee of revenue. Participation, selection, publication, ratings, or inclusion in a Collaborative Work does not guarantee sales, licensing, adaptation, or payment. Revenue credits arise only when the applicable program terms say they arise and when the corresponding revenue is actually received or otherwise recognized under those terms.
We may suspend, restrict, or terminate an account for material violations, fraud, abuse, security concerns, legal requirements, or conduct that creates material risk to Novelhaus, users, contributors, or third parties. Where reasonably appropriate, we may provide notice or an opportunity to cure, but immediate action may be taken when necessary.
You may request account deletion through available account tools. Personal information will be handled under the Privacy Policy and applicable law. Account deletion does not automatically cancel a finalized Collaborative Work's copyright-ownership allocation, SAMCHEONGHAUS Inc.'s centralized copyright-administration authority, accrued contributor rights, publishing commitments, or valid third-party licenses. Content already incorporated into a finalized or published Collaborative Work may continue to be retained, attributed or pseudonymized, distributed, and administered to the extent permitted by the applicable Author Terms. Unpublished content is handled under the applicable program terms and our retention practices.
Sections that by their nature should survive termination—including finalized copyright allocations, rights-administration authority, licenses needed for already published works, accrued payment obligations, warranty disclaimers, liability limitations, indemnification, and dispute provisions—will survive to the extent legally enforceable.
The Platform, including beta features, user content, ratings, recommendations, and AI-assisted output, is provided "as is" and "as available." To the maximum extent permitted by applicable law, SAMCHEONGHAUS Inc. disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, security, accuracy, and reliability. We do not guarantee publication, audience growth, sales, licensing, copyright registration, commercial success, or any specific creative result. Rights that cannot lawfully be disclaimed remain unaffected.
To the maximum extent permitted by applicable law, SAMCHEONGHAUS Inc. and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, opportunities, data, goodwill, or business arising out of or relating to the Platform, user content, AI-assisted output, or participation in an author program.
To the maximum extent permitted by applicable law, our aggregate liability for claims arising out of or relating to the Platform will not exceed the greater of (a) the amount you paid to Novelhaus or received from Novelhaus in the twelve months preceding the event giving rise to the claim or (b) US $100. This limitation does not apply where applicable law does not permit it or to liability that cannot legally be limited.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless SAMCHEONGHAUS Inc. and its officers, directors, employees, and agents from third-party claims, losses, liabilities, damages, and reasonable legal costs arising from: (a) your User Content; (b) your material breach of these Terms or applicable program terms; (c) your violation of law; or (d) your infringement or violation of another person's rights. We may assume control of the defense of a covered matter, and you agree to reasonably cooperate.
Governing law. These Terms are governed by Delaware law, without regard to conflict-of-law principles, except to the extent that applicable federal law or non-waivable law of your place of residence controls.
Informal resolution. Before starting arbitration or litigation, either party should send a written description of the dispute and requested resolution to hausnovel@gmail.com and allow at least 30 days for good-faith informal resolution.
Individual arbitration. Except for matters described below, disputes arising out of or relating to these Terms or the Platform will be resolved by individual, final, and binding arbitration administered by the American Arbitration Association (AAA) under the AAA rules applicable to the dispute, including the Consumer Arbitration Rules where applicable. The arbitration provision is intended to comply with the AAA Consumer Due Process Protocol where it applies.
Costs and hearing format. Consumer administrative fees and arbitrator compensation will be allocated under the applicable AAA Consumer Arbitration Rules. Hearings may be conducted virtually or at a reasonably convenient location as provided by the applicable rules, unless the parties and arbitrator agree otherwise.
Class action and jury waiver. To the maximum extent permitted by law, disputes subject to arbitration must be brought on an individual basis and not as a class, collective, consolidated, or representative action. Where arbitration applies, you and Novelhaus waive the right to a jury trial.
Exceptions. Either party may bring an eligible individual claim in small-claims court. Either party may also seek temporary or injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, account security, or to prevent unauthorized access or misuse.
Opt-out. You may opt out of the arbitration provision by emailing hausnovel@gmail.com within 30 days after you first accept the version of these Terms containing the arbitration provision. Your notice must identify your account email and clearly state that you opt out of arbitration.
If AAA will not administer. If the AAA declines to administer a dispute and the parties cannot agree on another appropriate arbitration provider, either party may ask a court of competent jurisdiction to resolve the dispute or determine the appropriate next procedure.
Nothing in this Section limits rights or remedies that cannot be waived under applicable law. Statutory limitation periods apply unless a valid written agreement provides otherwise.
We may update these Terms as the beta develops and before commercial launch. For material changes, we will provide reasonable advance notice through email, the Platform, or both. For material changes to creator compensation or publishing rights, we intend to provide at least 30 days' notice unless a shorter period is required to address law, security, fraud, or an urgent operational risk. Changes will not retroactively alter finalized copyright-ownership allocations, finalized contributor credits, revenue allocations, or vested payment rights unless required by law or agreed in writing.
